Accompanying Muslim who commits acts of Shirk to Hajj

Question

There is a woman who, though she claims to be Muslim, commits a lot of Shirk (polytheism). For example, she visits graves; wears "Taweez"; and goes to "Peer", fortune tellers, and magicians. She also believes in many weird things, like that the cause of rain would be such-and-such Hindu festivals, that wearing bangles would prolong the lifetime of the husband, that putting certain things in the house brings peace etc. If I am not mistaken, then by definition, "A Mushrik (polytheist) is someone who commits Shirk." So, according to the definition, the woman whom I have described above is a Mushrik. And we know that Mushriks are not allowed to perform hajj. Now, the question is, is it permissible for her to perform Hajj? And is it permissible for her Mahram (permanently unmarriageable kin), who is a good Muslim, to take her to Hajj while being aware of all her Shirk activities?

Answer

All perfect praise be to Allah, the Lord of the worlds. I testify that there is none worthy of worship except Allah and that Muhammad, sallallaahu ‘alayhi wa sallam, is His slave and Messenger.

Assuming that this woman has actually committed an act of major Shirk, she is not to be ruled as a Mushrik (polytheist), because there are a number of conditions that must be met and impediments that must be absent before judging a Muslim to be a Mushrik. Fatwas 8106 and 87963 detailed those conditions and impediments.

She is a Muslim in principle, so she performs Hajj, like Muslims do, and her husband accompanies her. However, she should be taught her religion, and the evidence should be explained to her beyond the excuses of ignorance, as well as the fact that it is very dangerous to her if she insists on continuing to do what may take her out of the fold of Islam.

It is advisable that you seek the help of reliable scholars and preachers who teach the Muslims in her country or in Saudi Arabia. She is also in need of the sincere supplications of her fellow Muslims asking Allah to bless her with repentance and guidance.
