She traveled to Jeddah to visit her daughter and wants to perform ‘Umrah

Question

A woman came from Egypt to visit her daughter in Jeddah. She wants to perform ‘Umrah although she did not enter the state of Ihraam in Egypt. Can she start her Ihraam in Jeddah or must she go to another place, noting that she has stayed in Jeddah for three days now? Thanks.

Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah and that Muhammad, sallallaahu ‘alayhi wa sallam, is His slave and Messenger.

If this woman came to Jeddah for visiting her daughter with no intention to perform ‘Umrah, then it occurred to her to perform ‘Umrah while she is in Jeddah, then she must make Ihraam from where she stays. Her Miqaat is the place from where she initiates the Umrah, for Ibn ‘Abbaas  may  Allaah  be  pleased  with  him quoted the Prophet, sallallaahu ‘alayhi wa sallam, as having said, after mentioning the Miqaats of Ihraam, “These [Miqaats] are for their dwellers and for those who come thorough those places with the intention of performing Hajj and ‘Umrah; and whoever is living past these points can assume lhraam from the place he is, and the people of Makkah can assume Ihraam from Makkah.” [Al-Bukhari and Muslim]

If she came to visit her daughter with the intention of performing ‘Umrah, then she must assume Ihraam from the Miqaat that is due for those coming from Egypt, namely Al-Juhfah. Now, those coming from Egypt assume Ihraam from Raabigh because Al-Juhfah has been devastated.

Since she did not assume Ihraam at the Miqaat, she must go back to the Miqaat and assume Ihraam there. She is not liable to a sacrificial animal if she does that, according to the sound opinion. But if she assumes Ihraam at a place that is past the Miqaat (i.e. Jeddah), then she has to slaughter a sacrificial animal. Ibn ‘Abbaas  may  Allaah  be  pleased  with  him said, “Anyone who overlooks one of the rites is liable to a sacrificial animal.”
