Paying Zakah on Jewellery

Question

1. What is the evidence that Zakat must be paid *annually* on a woman's gold jewelry?2. When either the husband or the wife is in debt and all the money has been spent - is Zakat obligatory on the wife's gold jewelry and the husband's income?If so, how can Zakat be paid on the gold jewelry and the husband's income when there's no money?Please send the answer from the Quran and Hadith, Insha Allah.

All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad is His slave and Messenger.

There are some ambiguities in your question, therefore we advise you to consult one of your local scholars, but we can assist you in the following:

First: Woman’s Jewellery, if it is intended for personal use and adornment, is not subject to Zakah according to the opinion of the majority of scholars, which is the opinion we adopt here (in Islamweb). Some scholars, however, hold that Zakah is obligatory on it. According to the majority, there is no Zakah due on gold at all if it is intended for personal use.

Second: If you want to be on the safe side and pay its Zakah or if this gold is not intended for adornment and personal use, then Zakah is not due on gold unless it reaches the Nisab (the minimum amount on which Zakah is obligatory), which is equivalent to 85 grams, and a Hijri year has passed after possessing it. You can pay the Zakah by selling some of it if you cannot find enough cash money to pay its value.

Third: There is no relationship between the husband's income and the wife's gold; the Zakah on gold is obligatory on the woman under the mentioned conditions, and the Zakah on income is obligatory on the husband if he saves from his income what reaches the Nisab and one Hijri year has passed after possessing it.
