Ruling on Purchasing a Bike Won Through a Lottery

Question

Assalamu Alaikum.Someone got a bike from paid raffle draw. As I know paid gambling is haram, Can I buy this bike from him with my halal money?

Answer

All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His slave and Messenger.

Lottery is a form of gambling that is prohibited in Shariah (Islamic law). As Allah the Almighty says: {O believers! Intoxicants, gambling, idols, and divining arrows are all filth of Satan’s handiwork. So refrain from them so you may be successful.} [Quran 5:90].

Furthermore, since this prize is acquired from a lottery, it has to be spent on the public benefit of Muslims or given to the poor and needy. Similarly, the one who received it does not have the right to sell it for personal gain, and therefore, you are not permitted to purchase it from him, as he does not (legally) own it.
