Question

I am in the Kafir country, and I would like to protect my self from Zina. I asked Muslims here to marry but I was rejected because I am a student. So can I marry a Kafir girl who announces Islam just by her mouth and I am not sure from her heart? I am in China and most people are communist or Buddhist.

Answer

All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His slave and Messenger.

All the Muslim scholars have agreed upon that a Muslim is not allowed to marry a non-Muslim woman such as idolatress, communist, atheist, etc., except a woman from the People of the Book. Allah Says (what means): {And do not marry polytheistic women until they believe. And a believing slave woman is better than a polytheist, even though she might please you.} [Quran 2: 221]

Marrying the women from the People of the Book is exempted for this verse; Allah Says (what means): {(Lawful to you in marriage) are chaste women from the believers and chaste women from those who were given the Scripture (Jews and Christians) before your time, …} [Quran 5: 5]

Know that marrying a Jewish or Christian woman is permissible only if two conditions are met: (a) She should be chaste and (b) adherent to her religion. But it is a fact that many of them at present are not chaste and are secularists; i.e., do not follow any religion.

However, if a non-Muslim woman embraces Islam follows the rulings of the Sharee'ah, then marrying her is permitted. Allah Says (what means): {And do not marry polytheistic women until they believe.} [Quran 2: 221]

However, we advise our brother to be patient till he completes his studies and returns to his country and then he should marry there a pious and good-natured girl. It is better to avoid taking any risk under the pressure of sexual desire. Frequent fasting will help you to control your sexual desire. The Prophet  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) said: “O young people! Whoever among you can marry, should marry, because it helps him lower his gaze and guard his modesty (i.e. his private parts from committing illegal sexual intercourse, etc.), and whoever is not able to marry, should fast, as fasting diminishes his sexual power.” [Al-Bukhari]
