Abused his retarded aunt sexually

Question

A person forced ahis aunt to be naked .She is mentally abnormal. He didnt penetrated his sexual organ in her any holes.neither back nor front. But in her hips. He wants to know the punishment for his blunder

Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His slave and Messenger.

There is no doubt that what this person did is a great sin which requires him to repent to Allaah. Forcing a woman to be naked is a great sin. This sin is even greater if it is done with a non-marriageable woman, and it is even more heinous if he tried to commit Zina (fornication or adultery) with her. Therefore, this person is obliged to immediately repent to Allaah, and his friends or whoever knows what happened should advise him to fear Allaah and remind him of His severe Punishment.

The guardians of that woman should also protect her and prevent her from being in seclusion with the said person.

As regards his punishment if he persists on this sin and did not repent, he should be reprimanded with what will deter him if this act is confessed by him or proven against him with evidence which can be legally authorized. However, it is only the judge who may inflict Ta’zeer (a discretionary punishment) on this person, reprimanding him and disciplining him. Ta’zeer is an obligation in every sin in which there is neither Hadd (i.e. the corporal punishment determined by the Islamic Law) nor asset expiation, like enjoying a woman [other than fornication or adultery] on which there is no Hadd, or having foreplay with a woman without anal or vaginal intercourse.

Finally, it should be noted that if a person is afflicted with such sins, he should conceal his sin and not inform anyone about it, and he is obliged to repent to Allaah. For more benefit on the conditions of repentance, please refer to Fatwa 87903.
