Question:

Assalamu alaikum Mufti Sahib If the dead body of a muslim is taken to graveyard, but grave has not been completely digged up and it will take considerable time to complete the grave.Should the dead body retained there or be sent back to home?

Answer:

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad sallallaahu `alayhi wa sallam ( may Allaah exalt his mention ) is His slave and Messenger.

It is permissible to keep the corpse in the graveyard until the grave is dug up, and it is not an obligation to return it home.

It is confirmed that Al-Baraa’ ibn ‘Aazib may Allaah be pleased with him narrated that the companions may Allaah be pleased with them went out with the Prophet sallallaahu `alayhi wa sallam ( may Allaah exalt his mention ) in a funeral of an Ansari man and when they reached the graveyard, the grave was not yet dug up, then the Prophet sallallaahu `alayhi wa sallam ( may Allaah exalt his mention ) sat around the grave and the companions may Allaah be pleased with them sat around it as well, until digging the grave was finished. [Ahmad]

However, it was not reported in the narration that he sallallaahu `alayhi wa sallam ( may Allaah exalt his mention ) ordered the corpse to be returned home.

Allaah Knows best.
