Her husband neither spends on her nor lives with her

Question:

Salamualikumwarahamtullahiwabaraktuhu 5 years bak I got married then after a year my huband gave divorce to me bcoz he was invovled with some another women I'm having a child from him.Then after 7 months again I got married Alhumdulillah and I'm his 2 wife he is doing job in Dubai.After Nikah he has spent only 5 days with me and now its more than 3 years he didn't come from Dubai and he never sends me money for my expenditure ,he told me to do job bcoz he can't give money for my expenses whenever I ask him to send money he always says he is having 2 daughter's from his first wife so he is having much responsibilty of them.I'm doing job as a teacher and taking tutions and through this I'm meeting my expenses.I can't share my problem with my family memebers bcoz they will not suppot me in any matter.My husband told he will come this year to India inshallah(not sure also about it) What should I do in this case? please advice me I can't live my life doing much work and that to alone.Masalam

Answer:

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His slave and Messenger.

 

The husband is Islamicly obliged to spend on his wife as discussed in Fatwa 85361. Also, he is Islamicly obliged not to be absent from his wife more than six months without her permission as discussed in Fataawa 88642 and 84073.

Therefore, your husband is obliged to spend on you, and it is permissible for you to ask him to compensate you for the expenses that you spent on yourself during his absence for the entire previous period [3 years]. He is also obliged to come to reside with you or take you to reside with him. If he does not do one of the above two options, then you have the right to ask for divorce but if it is better for you to keep your marriage and stay with him, then we advise you to be patient.
