Ruling on throwing pebbles after midnight for the next day

Question:

I performed Hajj this year with a Hajj campaign and threw the pebbles for the first Day of Tashreeq after the ‘Asr Prayer. Then we spent the rest of day in Mina until midnight. Some minutes shortly, we threw the pebbles for the next Day of Tashreeq considering that the second day of Tashreeq began. Is that permissible? Are we liable to anything? After we had thrown the pebbles, we went to make the farewell Tawaaf. Am I liable to anything?

Answer:

All perfect praise be to Allaah, The Lord of the worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad, sallallaahu ‘alayhi wa sallam, is His slave and Messenger.

 

Throwing the pebbles for the second Day of Tashreeq after midnight preceding the Second day of Tashreeq is invalid under Sharee‘ah. This is because throwing the pebbles for each day of Tashreeq starts after that day’s noon as mentioned by the majority of scholars from among the righteous predecessors and late scholars. According to an opinion of Abu Haneefah  may  Allaah  have  mercy  upon  him it is permissible to throw before noon, but this opinion is outweighed. In principle, throwing before dawn was not suggested by any scholar, to the best of our knowledge. Hence, you must offer a sacrificial animal for not throwing the pebbles during that day. Ibn ‘Abbaas  may  Allaah  be  pleased  with  them said, "The pilgrim who leaves or forgets any part of the rites has to offer a sacrificial animal."

Also, the farewell Tawaaf that you made is invalid as well, because you made it before completing the rites and throwing the pebbles in the way approved by Sharee‘ah. There is no difference whether you made it or not, and thus you must offer a sacrificial animal. Each of you must offer two sacrificial animals, one for not throwing the pebbles (in the prescribed time) and the other for not making the farewell Tawaaf.

Our advice to you and Muslims in general is to learn the rulings of Sharee‘ah, because these mistakes are committed only out of ignorance.
