Wants to forge papers to bring his second wife to live with him in the country where he works

Question:

1) IAM AN INDIAN RESIDING WITH MY FIRST WIFE IN SAUDI ARABIA .RECENTLY I DID SECOND MARRIAGE IN MARCO FOR WHICH MOROCCAN GOVERNMENT REQUIRES A FIRST WIFE AUTHORIZATION AS A PART OF MOROCCAN POLYGAMY FOR WHICH SHE FORCED ME TO FORGE THE AUTHORIZATION CERTIFICATE TO GET THE PERMISSION FROM MOROCCAN COURT. AS PER THE COURT IT IS RECORDED OFFENCE. 2)SAUDI ARABIAN RULES WILL NOT ALLOW TO BRING SECOND WIFE AND THE SAME I CONFORMED WITH MY SECOND WIFE BEFORE MARRIAGE,NOW SHE IS IMPOSING ISLAMIC RULES AND BLACKMAILING AS PER ISLAM. 3)SHELL I BRING HER TO SAUDI ARABIA WITH SERVANT VISA TO RESIDE WITH ME, IAM AFRAID IT MAY AGAIN CHEATING TO SAUDI GOVERNMENT LAW WHAT ARE ISLAMIC RULINGS IN THIS CONCERN. 4)IAM NOT HAVING CHILDREN, THE MAIN INTENTION OF SECOND MARRIAGE IS THIS BUT SECOND WIFE SIMS SICK WHICH WAS KEPT SECRET BEFORE MARRIAGE ALWAYS SHE IS SUFFERING WITH LOW BLOOD PRESSURE ALONG WITH OTHER HEALTH PROBLEMS WHICH IS NOT SUPPORTING FOR PREGNANCY MOST OF THE TIME SHE IS SPENDING IN HOSPITALS.ALWAYS SHE IS BINDING ME WITH ISLAMIC RULES. 4)IF I BRING HER TO SAUDI ARABIA ON SERVANT VISA MY FIRST WIFE IS NOT AGREEING TO ALLOW HER IN ONE ROOF EVEN I FORCED HER.

Answer:

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad, sallallaahu ‘alayhi wa sallam, is His slave and Messenger.

When you apply for a residence permit in a given country and the concerned authority grants you the right of residency and you choose to settle in that country contentedly and willingly, this is considered an implied pledge on your part not to violate the laws of that country and to abide by them. It also implies that the authorities stipulated a condition upon you to do that. Allaah, The Exalted, says (what means): {O you who have believed, fulfill [all] contracts …}[Quran 5:1]

Moreover, the Prophet, sallallaahu ‘alayhi wa sallam, said: “Muslims are held to their conditions.” [Abu Daawood and At-Tirmithi] If the country does not allow you to bring a second wife (to live with you there), then it is incumbent on you to abide by that rule and you are obliged not to bring your second wife; otherwise, you are not obliged to stay in that country. Moreover, forgery, in essence, is lying and this can incur harm on you in case you are reported to the concerned authorities in either of the two countries. In addition, it is impermissible for a husband to accommodate two wives in one house except with their consent as underlined in Fatwa 86977. Al-Mawsoo‘ah Al-Fiqhiyyah Al-Kuwaytiyyah (Kuwaiti Fiqh Encyclopedia) reads, “Muslim jurists unanimously agree that it is impermissible for a husband to accommodate his two wives in one house because this contradicts the religious directive for Muslim men to live with their wives in kindness. Also, because this may lead to hostility (between the wives) which is forbidden in Islam. The Islamic Sharee'ah deems it forbidden for the husband to accommodate his two wives in one house because providing a separate accommodation for the wife is her due right over her husband and it is waived only with the consent of the two wives according to the opinion of the majority of jurists. The Maaliki scholar Ibn ‘Abd As-Salaam maintained that this right is not waived even with the consent of the wife."

For all these reasons, it is impermissible for you to bring your second wife to that country or to accommodate her with your first wife in the same house.
