Question:

Asalamalikum, I have applied to the court . It is a money claim for an amount over 5000.The person who caused me a lot of hassle had disregared her debt and hasbeen very bad to me when i helped her out, she refused to respond and hasnot paid her debt, Im in emotional distress everyday because of this , thisperson is in another country, she got deported back to Switzerland and idont know where she is, she did not leave her address and her country willnot give me her details, this has caused me even more hassle and depression, its very unjust that i have to pay for the crimes of a thief who harmed mewhich indicates that her letters to me were all lies, she was not a friendbut a user whom i dont even know. I have applied to the UK court money claimcentre against the Swiss represantation in the uk,because i believe that iam not responsible for a swiss prisoner/criminal, why should i pay forsomeone i dont even know, when i have a disabilit of autism, i believe thather people should pay for this, as i dont know who on earth she is, she isa criminal fraudster, i am now waiting for a court hearing and the defendantis the head of Switzerland's represantation in uk, my question is : can imake a letter that looks like that criminal had written it which will saythat the swiss benevolent society will pay on her behalf so as to make thempay compensation to me, her country and people should pay, do i have theright to make up a letter that says that she knows the swiss benevolentsociety and that they will pay me . all i want is for justice to be done.

Answer:

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad sallallaahu `alayhi wa sallam ( may Allaah exalt his mention ) is His slave and Messenger.

It is impermissible for you to resort to lying and forgery in order to oblige any organization to repay the money which that woman escaped with, for the reasons which we previously explained in Fatwa questions 142897 and 83137.

Justice entails punishing no one but that woman. It is not justice to make others, who had nothing to do with what she has done, pay for her crime, whether it is government organizations or any other entity, even if they have the ability to track her wherever she is. Indeed, you could have demanded guarantees for your money from her, but you failed to do so.

Rest assured that your right is not lost; if you do not get it back in this life, you will receive it in the Hereafter when you are in dire need of it. For more benefit, please refer to Fatwa 86374.

Allaah Knows best.
