Question:

Is it prohibited to sign a marriage contract or to consummate marriage in the Sacred months or at specific times? Is this based on a Sunnah-based or any other proof?

Answer:

All perfect praise be to Allaah, the Lord of the worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad, sallallaahu ‘alayhi wa sallam, is His Slave and Messenger.

Stating that contracting or consummating marriage in the Sacred months or at other specific times is an invalid saying that has no basis in the Sharee'ah. It is, in fact, a pre-Islamic habit as Arabs would be pessimistic about marriage in the month of Shawwaal. ‘Aa’ishah may Allaah be pleased with her stated that the Prophet, sallallaahu ‘alayhi wa sallam, consummated his marriage to her in Shawwaal, even though the people of the pre-Islamic period were pessimistic about marrying in that month. They were also pessimistic about the month of Safar and Wednesdays. Islam declared that all this is invalid and considered it a type of polytheism. Moreover, the Prophet, sallallaahu ‘alayhi wa sallam, warned against pessimism itself. Signing a marriage contract is lawful at any time, except for a person in the state of Ihraam (ritual consecration) in pilgrimage until he comes out of the state of Ihraam.

Allaah Knows best.
