Pronouncing divorce to spite someone

Question:

Someone pronounced divorce to spite someone else. He was in an extreme state of anger.

Answer:

All perfect praise be to Allaah, the Lord of the worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad, sallallaahu ‘alayhi wa sallam, is His Slave and Messenger.

 

If the person who did so said one of the explicit words indicating divorce and he was in a state of anger where he did not lose his wits, then, his divorce  is effected. The Prophet, sallallaahu ‘alayhi wa sallam, said: “[There are] three [things] which, whether undertaken seriously or in jest, are [treated as] serious: Marriage, divorce and taking back a wife (after a revocable divorce).” [Abu Daawood; (Al-Albaani: Hasan)]
