Partnership with someone who deals with interest

Question:

We are 12 friends who purchased a piece of land, and we all contributed an equal amount of money. We have a plan to develop the land for joint housing, Allaah willing, as the land is about 2880 square feet. There is a chance that some of my friends may use a fund from an interest-based loan, but I and my other friends will use our own savings fund, Allaah willing. After developing the land, each will be the respective owners of their apartment. Is it permissible for me to own my apartment in this joint development of land?

Answer:

All perfect praise be to Allah, The Lord of the worlds. I testify that there is none worthy of worship except Allah and that Muhammad sallallaahu `alayhi wa sallam ( may Allaah exalt his mention ) is His slave and Messenger.

You should advise those friends not to take an interest-based loan and clarify to them that this is forbidden as it is authentically confirmed that the Prophet sallallaahu `alayhi wa sallam ( may Allaah exalt his mention ) said, “Allah has cursed the one who consumes interest and the one who gives it to others.” [Muslim]

The one who gives interest to others is the borrower who pays the interest, but if your friends insist on borrowing money (with interest) and participate with you in the construction, then the prohibition of that loan applies to those who borrow money with interest while there is no sin on other participants, and they [the latter] are entitled to benefit from their apartments in this project.

Allah knows best.
