Mother Gifted Her House to Widowed Daughter in-Law

Question:

Assalamoalakum, with all due respect I have a question regarding the property of my mother. My brother died due to cancer a few years ago. My mother was having a house and after few days of death ho gifted that house to my brother wife. Is it according to Quran and Sunnah. We are 3 daughters of her however she didn't even discuss with us . We came to know this after years that father of my brother wife insisted to my mother and it happened. I am just worried if my mother has done right as per Quran or Sunnah , was she has right to that. Jazakallah

Answer:

All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His slave and Messenger.

The gift of a mother who is in sound mind of her home to her widowed daughter in-law is permissible and it is not in violation to the Quran or the Sunnah. As long as the house is her property, she has the right to dispose of it in her life and while she is in good health, and she is not obliged to seek the permission for her children or others, or to inform them of that.

Accordingly, what your mother did is correct in the scale of the Sharee’ah, and it is one of the righteous deeds for which a great reward is sought.
