The Maliki Ruling on Eating Predatory Animals and the Status of Their Impurities

Question:

Assalamualaikum , is is true that in the maliki madhab eating animals with canine teeth is only discouraged and this would mean since u can eat that that there urine and feces is also tahir ?

Answer:

All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His Slave and Messenger.

The correct position in the Maliki school is that eating every animal possessing fangs among predatory beasts—meaning every animal that preys upon others—is disliked (makruh).

Al-Nafrawi  may  Allaah  have  mercy  upon  him stated in al-Fawakih al-Dawani in his commentary on the Risalah of Ibn Abi Zayd al-Qayrawani al-Maliki  may  Allaah  have  mercy  upon  him:

The Prophet  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) forbade eating anything from every beast possessing fangs, meaning every animal that has the strength to prey, such as lions, hyenas, foxes, and wolves.

Note: The author’s statement, ‘He forbade…,’ does not clarify the legal implication of the prohibition. We have previously mentioned from Khalil that it indicates dislike (karahah), and this is the well-known position and the one upon which fatwa is given.” [End quote.]

Al-Hattab al-Maliki  may  Allaah  have  mercy  upon  him said in Mawahib al-Jalil, commenting on the author’s statement in the Mukhtasar: “And disliked are predatory beasts such as lions, hyenas, foxes, and wolves”:

The basis of the dislike in all of these is their predatory nature. Ibn ʿAbd al-Salam  may  Allaah  have  mercy  upon  him said: The original meaning of predation in the Arabic language is crushing the neck, then it came to be used for every form of killing.” He then said in al-Shamil: “Predatory animals are disliked according to the sounder opinion.” [End quote.]

The well-known position in the Maliki school is that the urine of predatory animals—whose meat is disliked—is impure. Al-Kharshi stated in his commentary on Mukhtasar Khalil:

As for the urine and droppings of animals whose meat is disliked, as well as those permissible animals that consume impurities, then they are impure according to the school, though it is also said that they are disliked.” [End quote.]

Thus, according to the Malikis, there is no necessary linkage between the ruling on the meat and the ruling on the animal’s waste, as you have seen.
