Buying Car on Lease Agreement

Question:

I would like to ask you a question about buying a car by leasing. My wife wants to buy a car; we don't have money to pay cash and we don't have an Islamic bank in our country (Morocco). She needs to have a car to go to her work and avoid to taking public transportation because it's very bad and unrespectful of women.

Answer:

All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His slave and Messenger.

For the ruling of the Shari'ah concerning buying a car by leasing, please refer to Fatwa 81863.

As a rule, what is forbidden cannot become lawful unless there is a dire need. So, if your wife is in dire need to work and she cannot go there safely by using public transportation, then she can buy a car by the way you mentioned as long as there is no other legal way.
