Question:

I am married and I swore Talaq to my wife that I wouldn't sleep with her for a month. Almost ten day's have gone past and I don't think I can take another 21 day's. Is there anything I can do to go back to having normal relations with my wife?

Answer:

All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad sallallaahu `alayhi wa sallam ( may Allaah exalt his mention ) is His slave and Messenger.

Many scholars are of the opinion that whoever takes an oath of divorce; i.e., he takes an oath that if he does a certain thing, his wife will be divorced, then this kind of oath cannot be abrogated nor cancelled. Therefore, if he breaks his oath, the divorce will be effective. So, you have to avoid your wife during the mentioned period; otherwise, the divorce will occur.
We would like to inform you that using divorce as a means to solve the marital problems is not an acceptable way since its result will always be unpleasant.
