Inheritance of deceased husband

Question:

I want to know the inheritance shares in case husband dies and leaves behind father, mother, wife and one daughter or one son.

Answer:

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger. We ask Allaah to exalt his mention as well as that of his family and all his companions.

 

If a man dies leaving both parents, a wife, and a daughter, as his inheritors, the daughter gets half of the inheritance, the wife gets one-eighth and his mother gets one-sixth of the inheritance. The father gets his fixed share, i.e. one-sixth in addition to the whole remaining inheritance, after allotting to those who have a fixed share in the inheritance, since he is the nearest male relative of the deceased.

For instance if the deceased leaves 24 European Euros, his wife gets 3 Euros, his daughter gets 12 Euros, his mother gets 4 Euros and his father gets 4 Euros as his fixed share, and another remaining Euros since he is the nearest male relative of the deceased.

The Prophet  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) said: "Give the prescribed share to those who are liable for that and the remaining inheritance is for the nearest male relative." [Al-Bukhari and Muslim]

If the deceased has a son instead of a daughter then the remaining inheritance is allotted to him instead the father of deceased as proved by the above narration.
