Only sibling who contributed financially to building a house with his parents

Question:

I have contributed to the building of a house with my parents but I did not keep record of how much is my contributions. I have 2 sisters and we are 5 brothers, I am the only one who contributed financially with my parents. What will happen if my parents die and they haven't left anything in writing? The 2 sisters married and the rest of us too.

Answer:

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His slave and Messenger.

 

The money with which you helped your father to build this house is one of the two following cases:

1) Either you intended to help your father, and the ruling about this is the same as the one about a gift, that it is not permissible to take it back after it becomes in the possession of the person to whom it was given. If this is the case, then you and your brothers are the same in relation to this house.

2) Or, you intended to be a partner in the house with your money. In such a case, you are a partner in this house according to your contribution but you should document this while your father is still alive so that no disputes would arise later and lead to the cutting of relations with kin.
