Question:

What is the Fatwa of an activity of a person having taking candid pictures of couples having immoral activities, then circulate it to what ever means of mass communication? What is the Fatwa of an activities of a group of person having somebody letters for the pleasure of themselves or they do it for some sort of moral protection, but it is only a written love letter?

Answer:

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger. We ask Allaah to exalt his mention as well as that of his family and all his companions.

Whoever takes pictures of what takes place between men and women like sexual intercourse or its foreplay, he has indeed committed a great sin and a forbidden act for many reasons:

1)     Photography: the scholars may Allaah have mercy upon them differed in opinion regarding photography, however, they all agree that taking pictures of naked people is forbidden.

2)     Taking pictures of men and women in intimate acts.

3)     Distributing these pictures; this is the most serious of the three, as it leads to spreading immorality. Whoever does this forbidden act deserves indeed a severe punishment. Allaah says (which means): {Verily, those who like that (the crime of) illegal sexual intercourse should be propagated among those who believe, they will have a painful torment in this world and in the Hereafter.}[Quran 24:19].

Therefore, whoever is aware that this person is doing so, has to advise him but if he persists, then one must take his matter to whoever is able to prevent him from doing so.

For the other question read the Fatwa 82217

Allaah knows best.
