Sponsors taking money from workers for providing sponsorship

Question:

What is the Sharee'ah' rulings regarding Kafaalath which is collected by sponsors from the expatriate workers without providing works or any other facilities. They are finding jobs here and there and paying a fixed sum every month if the worker is having work or not?

Answer:

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His slave and Messenger.

 

It is not permissible for a sponsor to take money in return of his sponsorship because taking money for sponsorship is like consuming people's money without right. That is so because sponsoring is among the voluntary contracts and performing righteous acts by which one seeks Allaah's Pleasure.

However, if the sponsor had made an effort in carrying out the procedures of sponsorship, then he is allowed to take money for the work he provided and not exceed what he deserves.

As regards taking monthly wages from the sponsored people just for the sponsorship, then this is not permissible.
