Question:

If a woman swears when she is in menses or in postpartum bleeding, is her swearing effective or not?

Answer:

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger. We ask Allaah to exalt his mention as well as that of his family and all his companions.

There is no harm for a woman in menses or in postpartum bleeding to swear by Allaah but she has to expiate for breaking her oath if she fails to fulfil it. It is not forbidden for a woman who is in menses or in postpartum bleeding to mention Allaah, and there is no difference of opinion in this subject, but she is not allowed to touch the Quran according to the view of the majority of the scholars may Allaah have mercy upon them.

Allaah Knows best.
