Said to his wife, 'Your money is Haraam to me'

Question:

i am married from worker woman , i was told her that i will not accept any amont of your money , imean in arabic money will becom haram . after that i turn back and take from her money under her pressure and pursuant to her satisfy . please advise if my behave is accepted or not

Answer:

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger. We ask Allaah to exalt his mention as well as that of his family and all his companions.

 

If a person forbids something lawful for himself, this does not render that thing forbidden, like forbidding the wife's money as it is lawful if she gives it with full consent. Allaah Says (what means): {…but if they, of their own good pleasure, remit any part of it to you, take it, and enjoy it without fear of any harm (as Allaah has made it lawful).}[Quran 4:4].

However, the scholars  may  Allaah  have  mercy  upon  them differed in opinion whether or not forbidding what is lawful is an oath. There are two opinions about this. The first opinion is that forbidding what is lawful does not have any effect, and it is idle talk, except when making Thihaar, which is the saying of the husband to his wife "You are like my mother to me", meaning that ''You are (sexually) forbidden upon me exactly like my mother'' then his wife becomes temporary forbidden until he expiates his sin.

The second opinion is that forbidding what is lawful necessitates expiation; this is the view of the Hanafi School of jurisprudence and those who are of their opinion.

The most preponderant opinion is that one is obliged to expiate for this because Allaah named forbidding something as an oath, as He Says (what means): {O Prophet! Why do you ban (for yourself) that which Allaah has made lawful to you, seeking to please your wives? And Allaah is Oft-Forgiving, Most Merciful. Allaah has already ordained for you (O men), the dissolution of your oaths.}[Quran 66:1-2].

Therefore, in order to be on the safe side, it is better for you to expiate for breaking an oath, which is to feed ten poor persons, or clothing them, or freeing a slave, however, if you are unable to do these, then you should fast three days.
