A female slave whom the father enjoyed is forbidden to his son

Question

Assalamualikum My Question is: Quran 4:22 Marry not women whom your father married except what is past- so are the concubines of father also included?? can son inherit the concubines of father in islam?

Answer

All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His slave and Messenger.

There is no doubt that the slave woman of the father becomes the property of his heirs after his death, among whom is his son. However, if your question is regarding whether or not the son is permitted to have sexual intercourse with this slave woman when she becomes in his possession after his father's death, then there are some details about this. If the father had not enjoyed this slave woman [he did not have sexual intercourse with her], then it is permissible for the son to have sexual intercourse with her.

On the other hand, if the father had enjoyed his slave woman, then she becomes eternally forbidden for his son, just like the wife whom the father had married, and she [the slave woman] is included in the saying of Allaah (which means): {And do not marry those [women] whom your fathers married,…} [Quran 4:22] Ibn Katheer  may  Allaah  have  mercy  upon  him said: “The scholars agreed in a consensus that it is forbidden to have intercourse with the woman with whom the father had sexual intercourse by marriage, or by being possessed by his right hand (i.e. his slave woman), or by doubtful marriage as well.
