Rulings of marriage after converting to Islam

Question

السلام عليكمShaykh My two friends who were hindus and reverted to Islam. They both are cousins to each other.In there city from where they belong a custom is followed of buying and selling girls of lower caste by priest of temple as slave for upper caste also known as dev dasi. One of them bought the girl and that girl had given birth to his children.Now even that girl has accepted Islam along with children because as per their religious practices Dev Dasi will follow master in matter of religion this what was in grained in them as per Hindu religion.This is already Zina which happened before Islam. All of them are practicing and my friend also has distanced himself from her and vice versa.1. What will be ruling on maintaining name of father by child? 2. What will be ruling regarding inheritance? 3. Is it permissible for my friend to marry her? If yes, then what will be ruling applied for above two questions?

Answer

All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His slave and Messenger.

We congratulate your friends and this girl for the blessing Allah has bestowed upon them of entering Islam. We advise them to strive for everything that will help them to remain steadfast in it until death, such as learning Islamic knowledge, doing good deeds, keeping company with righteous people, and attending righteous gatherings.

If this relationship between him and the girl before their conversion to Islam was, according to their customs, a type of marriage, then this boy is attributed to him. Likewise, if they believe intercourse was permissible because he was her master, then his lineage is attributed to this man.

Islam demolishes what preceded it and erases the traces of adultery that preceded it. There is no harm in him marrying her with her guardian's permission if one of her guardians is a Muslim. Otherwise, the matter of her marriage will be handled by the Islamic bodies specialized in looking into Muslim issues. She can appoint a Muslim man known for being just to marry her if there are none.
