Performed a hysterectomy and wants to remarry after her husband's death

Question:

Your kind help is requested to answer my question in the light of Quran & Hadith:- The case is:- A married lady who has 6 children. Since she did not want to produce any more children and with the agreement of her husband undergone surgery to permanently remove the children producing portion from her body. Almost 12 years passed, she is healthy. Sudden her husband died. Her children already grown up and they are now elder. Fortunately a proposal came to her offering marriage. My question is – Can she marry and is it legal if she marry when her condition is that she cannot produce any more children. Kindly answer in the light of Quran and Hadith. Thanks

Answer:

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger. We ask Allaah to exalt his mention as well as that of his family and all his companions.

 

It is permissible for the woman who is mentioned in the question to marry, however, she is obliged to inform whoever wants to marry her that she cannot give birth to children so that she will not cheat or deceive him.

Imaam Ahmad  may  Allaah  have  mercy  upon  him said about a man who is barren and who wants to marry: ''If he is barren, I prefer that he informs whoever he wants to marry about it.", and the same thing applies to a woman.
