You may eat from the food of your sister’s children

Question

Asalaamu, aleykum. Q my sister goes to work I look after her kids she some time bring some food 4 them, is it halal for me & my kids to eat their food.

Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger.

Eating from the food of one’s relatives, whether they be a sister, a maternal or paternal aunt, or the like, is something that is known in the customs and there is no harm in doing so without their permission, especially if the food is in excess of their need or that it is going to be spoiled or rotten. Allaah Says (what means): {There is not upon the blind [any] constraint nor upon the lame constraint nor upon the ill constraint nor upon yourselves when you eat from your [own] houses or the houses of your fathers or the houses of your mothers or the houses of your brothers or the houses of your sisters or the houses of your father’s brothers or the houses of your father’s sisters or the houses of your mother’s brothers or the houses of your mother’s sisters or [from houses] whose keys you possess or [from the house] of your friend.}[Quran 24:61]

Al-Baghawi said: “What is meant (by this verse) is that there is no constraint to eat from the homes of these people if you enter them, even if they are not present, but you should not carry or take away any of it.” Ibn Katheer said: “If you know that this does not cause any hardship to them and they do not dislike that (i.e. they do not dislike you taking from it).”

Moreover, Al-Qurtubi said that the ruling of this verse is still effective and not abrogated according to the most preponderant opinion of the scholars, and that a man may eat from the money (food) of his relative or his agent or his friend what he knows that he will accept without any reluctance.
