Using People's Belongings Without Permission

Question

Assalamualekum. If one uses or takes things that belongs to someone for example perfume, brush, clothes, without asking them, but thinking that most likely they won’t mind. Is this permissible?

Answer

All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad is His slave and Messenger.

There is nothing wrong in using the belongings of a friend or relative without his permission if you know that he would not mind it and would be pleased.

Al-Qurtubi mentioned this from Qataadah and others in their interpretation of the following verse (what means): {There is not upon the blind [any] constraint nor upon the lame constraint nor upon the ill constraint nor upon yourselves when you eat from your [own] houses or the houses of your fathers or the houses of your mothers or the houses of your brothers or the houses of your sisters or the houses of your father's brothers or the houses of your father's sisters or the houses of your mother's brothers or the houses of your mother's sisters or [from houses] whose keys you possess or [from the house] of your friend...} [Quran 24:61], He (Al-Qurtubi) said: "It was mentioned in the Great Fataawa of Al-Haytimi, (he was asked) with the following wording: Is the permissibility of taking something without permission while knowing that the owner would be content general and encompasses everything, or is it specific to the food offered to the guest? He replied: 'Their words (scholars of Tafseer) indicate that it is not specific to the food offered. Additionally, they clearly stated that it is enough for one to predominantly believe (that the owner of what he is taking does not mind) and does not have to be positively sure, both cases take the same ruling. Therefore, if one thinks that the owner would most likely approve for him to take something from his property without permission, then it is permissible for him to take it. However, if he discovers that the opposite is true, then he has to guarantee what he took (or used)." [End of quote]
