Recording someone's call without his permission

Question

As Salam Alaykum beloved shaikh, is it permissible to record sales call, just for my personal use, to see where I could have performed better and improve myself? May Allah reward you with goodness in this world and hearafter.

Answer

All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad is His slave and Messenger.

In the Arabic section, we mentioned in previous fatwas that if the caller does not dislike recording his call, then there is nothing wrong with that. However, if he doubts whether the caller dislikes it or not, then let him ask the caller first and take his permission to do so. It is not honest to record a call if the person (caller) does not like his call to be recorded and does not allow that. Thus, do not record someone's call without his permission unless you already know his contentment. As for what you have mentioned about improving performance, we do not see it as a justification for recording against those who do not allow recording. You can put a recording at the beginning of the call indicating that the call will be recorded to ensure quality improvement, for example, as some institutions and companies do.
