Husband Does Not Pray
Fatwa No: 86012

Question

My husband does not pray. What can I do for him?

Answer

All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad is His slave and Messenger.

The prayer is the most important pillar of Islam after the Shahaadatayn (The Two Testimonies of Faith –which is to say: La Ilaaha Illa Allah Muhammadan Rasoolu Allah; meaning: there is None worthy of worship but Allah and Muhammad is his Messenger). It is the incarnation of the true belief and its most outstanding symbols. The evidence for this is the fact that the person who gives up praying is considered a Kaafir (disbeliever). So, you know from the above the great danger of what your husband committed. So, you should urge him strongly to repent from this major sin. Inform him that the bond of marriage between you and him is invalidated according to the Sharee’ah unless he gives up this obnoxious sin because the Muslim woman is forbidden to the Kaafir (disbeliever).

Allah Says (what means): {They are not lawful [wives] for them, nor are they lawful [husbands] for them.} [Quran 60: 10]

Remind him of the punishment of Allah in this worldly life and the Hereafter. If he is convinced, that's good; otherwise, you should refuse to let him have any intimate relations with you and you should tell your Wali (guardian) about the issue. If that helps then it is good; otherwise, you should present your case to the Muslim ruler or anyone who could compel him to repent or to separate from you.
