Palestinians are selling their land possibly to a Jew
Fatwa No: 88030

Question

I am a Palestinian who lives in the US. My family back in Palestine is selling a piece of land for over 20 million dollars, and my share from that will be almost $600,000 US dollars, and there are some rumors that the buyer might be Jewish but through a Saudi man. This is only a rumor; I am not sure, but the buyer is Saudi. My question is my share of the money Halal, or is it Haram? But there is no way I can stop the sale my self because I am only one person out of the many. So, if I get the money, Can I feed my kids with it? Again, is it Halal, or Haram? As I told you before it is only a rumor.

Answer

Praise be to Allah, the Lord of the Worlds; and may His blessings and peace be upon our Prophet Muhammad and upon all his Family and Companions.

Palestinians should never sell land to Jews no matter how much these Jews pay.  The reason is that these Jews are enemies and the land helps them do more oppression and practice more tyranny.

There is no difference in this ruling between selling the land directly to them or through a broker as in both cases; it is they who will own the land.

Now, if one of the heirs without the consent of his partners in the inheritance sells a piece of land to some Jews, it is he who is held responsible for this transaction and the sin is incurred by him.  But if some of these heirs, or all of them give their consent to this deal, then they all fall in sin.  Although the person(s) who sold the piece of land are sinful, the deal is valid if it meets the conditions of valid transactions.  This is because initially selling and buying are lawful with the People of the Book.  But in this transaction, they are made forbidden for a temporary reason.

From the above we conclude that there is no objection to take your share of the inheritance and spend from it on yourself and on your family provided the deal has already been struck.

Allah knows best.
