Question

First and foremost I appreciated how well you are serving our religion. After that I would like to clarify my doubts related to a marriageable question.
I want to marry a girl but she was born before Nikaah or agreement marriage, she is pious girl, she says her prays she wears Hijaab she behaves like a pious girl. She fears Allaah she would like to be as pious women who were companions of our Prophet, sallallaahu alayhi wa sallam. Now she lives a Muslim country (Yemen) but she belong to Somalia (Muslim country also), I know her very much because we are far relatives and know her relatives also, that is why I know her character very much. Once upon time she was our home for a short period. She fears men at all, at that time I was a young boy. she is not so beautiful, she is a normal girl, her uncles (brothers of her father) are good people, if I talk myself, I'm a BMA student I will graduate next year Inshaa Allaah, I intended to marry her because, I want to marry a pious woman who supports to me to obey Allaah and I want to serve our religion so it is necessary to marry a pious woman who brings also our children (if Allaah gives us) manners which Allaah loves and His messenger (Prophet) I'm religious man and to be pious till my death, as I'm a educated person, I would like to call my relative to obey Allaah truly, they are truly believers but to be truly more as Allaah ordered to every person to save their relatives hell its food is stones and people and more even I want to be a example for them what I'm calling for means I want to marry pious woman and behaves as our Prophet and companions behaves their wives so that they recognize their eyes, but the big problem is that my family know that she was born before Nikaah or agreement marriage, so they will come resistance against that, they will refused to marry her, but they know she is a pious girl, as you know modern Muslims are same wherever they are in world they considered their culture more than their religion, my family they will say something about this marriage they will say this marriage will affect your children especially your daughter at time of their marriageable age, and I'm not standing my own legs because I need their support to marry that girl, anyway I will convince them if our religion allows me to marry her otherwise there is no question at all, in short is a lawful to marry her or not. If happened story like this during life time of our Prophet also support your answer I would like to present in front of my family to support my decision. Please answer as possible I also sent a question its number is 143950 but still I didn't get its answer.

Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger. We ask Allaah to exalt his mention as well as that of his family and all his companions.

There is no harm in marrying a woman who is born out of an illegal sexual relationship as long as she is religious and has a good moral conduct. However, it is more proper to marry a woman who has a good family lineage and is from a noble family and is religious with good moral conduct, in order to achieve some objectives and avoid some expected disadvantages in marrying with a woman who is born out of an illegal sexual relationship. On this regard please refer to Fatwa 86437.

Nonetheless, if you wish to get married to this girl, then you must endeavour to convince your family to accept your marriage to her. If this has been achieved, all perfect praise be to Allaah, otherwise it is better for you to marry another woman. If those who are objecting to your marriage are your parents, then you are obliged to obey them and not get married to her. Allaah could bless you with another woman better than her. We do not know of any evidence regarding stories of marriages with women who were born out of an illegal sexual relationship during the reign of the Prophet .

Allaah Knows best.
