Migrating from India to Canada

Question

If an Indian Muslim can immigrate to Canada for good life. Please reply in the light of Qur'an and Hadeeth. It is very important for our family, mother wants to immigrate to Canada, and her sister is there. Father wants to stay in India as he likes his place and people around. Financially we are not very well.

Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger. We ask Allaah to exalt his mention as well as that of his family and all his companions.

 

If a Muslim is able to perform the rites of his religion in his country even if it is a non-Muslim country and has the intention of migrating to another non-Muslim country, it is better for him to stay in his country of origin, as living among his people and his environment is likely to be easier for him than anywhere else. However, if he is not able to perform his religious rites in his country or is exposed to a harm that he could not bear, then he has to migrate if he can to another country where he can worship his Lord and be safe even if it is a non-Muslim country if he/she is unable to migrate to a Muslim country. This is in general. As regards the determination of your mother to move from India to Canada, the rule is that basically a wife should reside where her husband resides as long as she is not harmed by residing with him. Therefore, it is not permissible for your mother to travel to Canada unless the following conditions are met:

First, she should have the consent and permission of your father to travel. Second, there should be a sound religious reason for her to reside in Canada.

Third, she should be accompanied during the trip by her husband or one of her Mahaarim (non-marriageable relative).
