An inheritor dies before the distribution of the inheritance

Question

My parents have left me inheritance, which hasn’t been distributed amongst my brothers and sisters yet. And if i happen to die before the inheritance has been paid out, then will my kids get the inheritance?

Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His slave and Messenger.

Whoever dies before taking his share of inheritance from the dead person whom he is entitled to inherit, then his heirs will take his share after his death. For example, if a man dies and leaves behind his children (sons and daughters), and then one of them dies before taking his share from the inheritance of his/her father, then the heirs of this child will take his/her share and –as far as we know –there is no difference of opinion among the jurists in this regard.

Therefore, you should endeavour to divide the inheritance of your father so that each one of you will get his/her share and by doing so, you will avoid any reason that might be a cause of dispute between yourselves (as brothers and sisters) or between your children.
