His father is not just between his two wives

Question

I'm a 19 years old,my father is one of reich businessmen in the city,and he has 2 families but he isn't faire in many aspects to my mother and family.He is always biassed as mach as i cann't explaine. Is it haram if I spend money(without his permission) for things that are necssary e.g educational purposes and things that might not be necessary but also not haram(the are necessary in my stage)?

Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His slave and Messenger.

A father is obliged to spend on his children as long as they are young or unable to earn their living and provided they have no money, but he is not obliged to spend on his children who are adult and able to earn their living. Therefore, if he is not obliged to spend on you, you are not permitted to take from his money in order to spend on yourself except with his permission otherwise you are sinful. Even if we presume that you deserve that he spends on you, then it is a matter of difference of opinion among the scholars  may  Allaah  have  mercy  upon  them whether or not child’s education is among the obligatory spending upon the father. Some of them are of the view that it is an obligation upon him to spend on his children’s education whereas others are not of this view.

On the other hand, your father is obliged to be just between your mother and his second wife in regard to the obligatory spending, and he is obliged to spend on his young children. If he does not do so, your mother is permitted to take from his money to spend on her own self and on her young children.

Moreover, your father must also be just between his children in regard to gifting them and the like. He is required to be just between them in the same manner he likes them to be equally kind and dutiful to him.

Finally, it should be noted that he should be advised about all these matters in a soft and gentle manner.
