Question

Assalamualikum
Please advise me on the following in light of Islam:
My mom (who passed away last year)lost her both parents when she was a child. Her paternal aunty looked after her. This aunt of my mom have no relatives. My mom had gifted her aunt four gold bangles. When i was there for vacation this time, I took these bangles from her, with her permission promising to get her new ones ( the bangles were currently in bad state). But inside my heart I feared that someones else can steal them because these were the one my mom gifted her and my mom's aunt was very old and had no control in making decisions. She use to live in her house all alone.
She passed way today. Please tell me as what I should do with these bangles that were hers.

Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad sallallaahu `alayhi wa sallam ( may Allaah exalt his mention ) is His slave and Messenger.

If your paternal aunt had given you her bangles to possess them but you promised her to buy her new ones, then the bangles have become your property and you have the right to dispose of them as you wish.

However, if you had taken the bangles from her in order to keep them (for her) or in order to sell them so that you may buy new ones for her instead, then the bangles are a trust with which you are entrusted; in which case, they are a property of your paternal aunt that should be added to her inheritance and divided amongst her heirs after paying back her debts if any and fulfilling her will if any.

Allaah Knows best.
