Not Every Innovation Takes a Muslim Out of Islam

Question

Zaid ask a question to a one mufti that one person says that Its allowed to Says kafir all Bidati muslim so Mufti replied that Its allowed.So what is the Rul of Shariah on that mufti

Answer

All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His slave and Messenger.

This mufti has made a terrible mistake by saying this. Even though some of the late scholars said this, yet this statement is wrong and it was not said by any the eminent Imams (schoalr). It is definitely a mistake on the Sharee’ah.

To elaborate on this subject: some innovations are not Kufr at all, such as favoring ‘Ali, may Allah be pleased with him, over Abu Baker and ‘Umar  may  Allaah  be  pleased  with  them. But there are some innovations that take a person out of the fold of Islam, such as saying that Allah Almighty does not speak. However, we do rule the person who says these innovations that take a person out of the fold of Islam, to be a non-Muslim unless the evidence is established against him. This is because he might be excused due to ignorance or misinterpretation; so he does not become a non-Muslim.

It is in this manner that the Hadeeth in the books of Al-Bukhari and Muslim should be interpreted about the man who said to his sons: “When I die, burn me, then grind my ashes –after death – and then scatter my ashes in the air on a stormy day. His sons did as he had told them. Allah Almighty reassembled him and asked him why he had done that. The man said: “It is because of fearing You.” So Allah forgave him.” [Al-Bukhari and Muslim]

Allah forgave this man despite the doubt that he had about the ability of Allah in resurrecting him and reassembling him after he is burned. Allah forgave him due to his ignorance.
