Assalamualaikum
I have a question that due to some medical reasons I cannot study in university and I'm not interested in studying so can I take some money from my father who works in a bank and start some business with it will the money that I get from the business halal for me?
All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad is His slave and Messenger.
We hope there is no blame upon you for borrowing from your father's money even though he works in a usurious bank. The fatwa that we have recently issued in this regard is that it is permissible to benefit from the money earned from unlawful work, not the unlawful money itself, such as the stolen or forcibly-seized money.
That which is forbidden because of the way in which it is earned, such as usury and the like, is forbidden only to the one who earns it. The prohibition applies to the person who got the loan and it is not related to the money itself. So, it is not forbidden to deal with him in it, such as borrowing from him, eating and drinking, and the like.
This is evidenced by the fact that the Prophet – as narrated by Imam Al-Bukhari in his Saheeh - used to deal with the Jews, buying and selling, to the extent that he died while his armor was mortgaged with a Jew for barley he bought for his family. He
did so even though the Jews used to eat unlawful money and deal with usury – as Allah the Almighty says (what means): {[They are] avid listeners to falsehood, devourers of [what is] unlawful.} [Quran, 5:42]
This indicates that it is permissible to deal with the person whose money is forbidden because of the way in which it is earned. In his Mussannaf, Imam ʿAbd Ar-Razzaaq composed a chapter under the title of “Taʿaam Al-U’maraa’ Wa Akl Ar-Ribaa, in which he reported a Hadeeth reading, “A man once asked Ibn Masooʿd
saying, ‘My neighbor consumes usury, and he invites me to his banquet,’ whereupon he (
) replied, ‘You get its benefit, and he gets its sin.’ Al-Hasan was once asked, ‘Is it permissible to eat the food of the money changers?’, whereupon he replied, ‘Although Allah has told you that the Jews and the Christians consume usury, He made their food lawful to you.”
