Scholars must enjoin good and forbid evil

Question

Are there some acts which entail punishment when neglected, and some acts which entail punishment if committed, yet jurists cannot pass Fatwa regarding them? Could you please give me an example?

Answer

All perfect praise be to Allaah, The Lord of the worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad, sallallaahu ‘alayhi wa sallam, is His slave and messenger.

Clarifying the truth, enjoining what is good and forbidding what is evil is obligatory on scholars. They must carry out these duties within their capacity. Allaah The Almighty blamed the Jews for neglecting this duty, Saying (what means):

· {And you see many of them hastening into sin and aggression and the devouring of [what is] unlawful. How wretched is what they have been doing. Why do the rabbis and religious scholars not forbid them from saying what is sinful and devouring what is unlawful? How wretched is what they have been practicing.} [Quran 5:62-63]

· {They used not to prevent one another from the wrongdoing that they did. How wretched was that which they were doing.} [Quran 5:79]

Therefore, every deed that is judged by Sharee‘ah as a sin when done or neglected must be explained by the scholars. They must give advice to those who fail to observe the religious obligations and they must make the truth manifest. We do not know of any special deed which the jurists cannot address.
