Committed Zina Then Married Without Family's Permission

Question

I knew a guy who came to ask for my hand, but my family said, 'no' I stooped seeing him. Then one day he stooped me in the streets and said he loved me. I believed him and went to his house. He raped me then he said don't worry I'm going to marry you. We did without my family, but we had 2 witness and a Sheikh.

Answer

All perfect praise be to Allah, The Lord of the Worlds. I testify that there is none worthy of worship except Allah, and that Muhammad  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) is His slave and Messenger.

What happened to you is the result of violating the rulings of Sharee’ah and transgressing the limits set by Allah. A woman is not permitted to talk with a non-Mahram man without any necessity, let alone being with him in seclusion at his house.

Moreover, your marriage with this man, without having the consent of your Wali (guardian), is null even if it is completed in the presence of a Shaykh and two witnesses. So, your relations with this man would be considered fornication rather than a marriage. The Prophet  sallallaahu  `alayhi  wa  sallam ( may  Allaah exalt his mention ) said: “Any woman who gets married without the consent of her Wali, her marriage is invalid, her marriage is invalid, her marriage is invalid. If he had intimate relations with her, he has to pay the Mahr (bridal money) for enjoying her. If they dispute in guardianship, then the Sultan (ruler) is the guardian of anyone who does not have a guardian.” [Abu Daawood, At-Tirmithi, An-Nasaa-i and Ibn Maajah]

Therefore, you must immediately separate from that man and you should turn towards Allah in repentance for your bad actions.

In addition, you should respect the limits set by Allah, following His Commands and avoiding His prohibitions.
