Woman marrying a Christian to get a green card in US

Question

What does Islam say if you marry a Christian and pay him money to have your green card processes in the US? Is this considered Haraam?

Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger. We ask Allaah to exalt his mention as well as that of his family and all his companions.

It is not permissible for a Muslim woman to marry a Christian man, and if she marries him the marriage is void according to the consensus of the scholars may Allaah have mercy upon them. The source for this consensus is the saying of Allaah (which means): {And give not (your daughters) in marriage to Al-Mushrikeen till they believe (in Allaah Alone)…}[Qur'an 2:221].

The need for a residence is not an excuse to marry him, as this marriage is void and it is a transgression of the Limits of Allaah, and it is purely fornication if this man lives with you as a husband and wife. For more benefit, please refer to Fataawa: 87151 and 88406.

Allaah knows best.
