Ruling on missing succession and sleeping during the Farewell Tawaaf

Question

I performed Hajj this year and we hastened our departure in three days. On the last day, I carried out some acts that might have invalidated my Hajj. What I did was as follows:
I was very tired and sick during the Farewell Tawaaf, so I was obliged to take rest two times during Tawaaf: one time after the Maghrib Prayer which lasted for half an hour, and another time after the ‘Ishaa’ Prayer which lasted for one hour. I took a nap each time then resumed Tawaaf from where I stopped. Once we finished Tawaaf, we waited in the bus from 2:00 am till the Fajr Prayer so that the rest of pilgrims would arrive. The bus moved only at the time of prayer, but when I returned home I realized that I had been in the state of Janaabah on the last day. Was my Hajj valid or do I incur any sort of compensation?

Answer

All perfect praise be to Allaah, The Lord of the worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad, sallallaahu ‘alayhi wa sallam, is His slave and Messenger.

Your Hajj is valid – Allaah Willing – as long as you assumed Ihraam, stood at ‘Arafah, made Tawaaf Al-Ifaadhah and performed Sa‘y between As-Safa and Al-Marwah. The question, however, would be whether or not your Farewell Tawaaf is valid. If we said that it is valid, there would be no sort of compensation on you. If we said that it is invalid, you should slaughter an animal in Makkah and distribute its meat among the poor people living in the Sacred Precincts. Knowing that you were in the state of Janaabah on the last day of Hajj and you performed the Farewell Tawaaf in such a state, your Tawaaf would be invalid and you should slaughter an animal. If Janaabah occurred after Tawaaf, we should discuss what you did during it. Pausing two times during Tawaaf due to illness does not apparently invalidate Tawaaf. That is because succession – according to the preponderant opinion – in Tawaaf is an obligation which one could be released from for a valid excuse, and your illness is apparently an excuse. As for sleeping, if you slept during Tawaaf for a short time, the like of which does not invalidate ablution, it would not affect the validity of Tawaaf. If it was a deep sleep which invalidates ablution, Tawaaf would be invalid unless you performed ablution and continued Tawaaf – according to the preponderant opinion of the Shaafi‘i scholars. If you waited after the Farewell Tawaaf for a reason such as waiting for your companions while getting ready to travel, there would be no harm in it. If there was no reason and you waited for a long time, you would be required to repeat Tawaaf.

After this detail, if you made Tawaaf in the state of Janaabah or your ablution was annulled during it and you did not renew it, or you waited for a long time after it without a reason, your Farewell Tawaaf would not count under Sharee‘ah. Therefore, you would be required to slaughter an animal and distribute its meat among the poor people of the Sacred Precincts. Otherwise, you would not incur any sort of compensation.
