Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad sallallaahu `alayhi wa sallam ( may Allaah exalt his mention ) is His slave and Messenger.

If this girl is religious and has a good moral conduct, then we advise you to keep her as your wife and not divorce her. A pious woman helps a person in his worldly and religious matters. ‘Abdullaah ibn ‘Amr may Allaah be pleased with him narrated that the Prophet sallallaahu `alayhi wa sallam ( may Allaah exalt his mention ) said: This whole world is a provision and the best object of provision of this world is a pious woman.” [Muslim]

The fact that a woman is not virgin is not evidence that she committed Zina (fornication); virginity may be lost by many reasons other than Zina. If we presume that she had committed Zina, then what should be taken into account is her situation now, if she had repented and her conduct became better; for more benefit, please refer to Fataawa 90483 and 86394.

Moreover, a person may be sometimes blessed with a virgin wife who did not commit Zina before, but her bad conduct renders the life of her husband miserable and the fate of such a marriage will be failure. Allaah Says (what means): {For if you dislike them — perhaps you dislike a thing and Allaah makes therein much good.}[Quran 4:19]

Allaah Knows best.
