Fatwa CenterReceived a marriage proposal from a man who wants her to live with his family
Question
My parents have received a proposal for me.The guy lives in joint family system & i wont b alowed to cover my face in front of the male family members,though they have no objection in my observation of hijab outside home(they say that at home i can wear a scarf over my ordinary clothes if i like)...my mom's a little upset as this is the second time this is happening.kindly guide me on the matter"
Answer
All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad, sallallaahu ‘alayhi wa sallam, is His Slave and Messenger.
The wife has the right to have a separate accommodation where she can enjoy her daily activities without embarrassment. So, the husband has to provide this accommodation even in a separate part within the family house that has its separate facilities. For further information, see Fatwa 89954.
However, if the husband is not able to do that and the woman accepted to live in the family house, she must observe the proper Hijab before her brothers-in-law. The face also should be covered, since covering the face is obligatory according to the preponderant opinion of scholars as previously clarified in Fataawa 83702 and 81554.
If you fear that these matters will create disagreement after marriage and thus may lead to divorce, it is preferable to break this engagement because engagement is just a promise between the two parties and each of them has the right to dissolve it whenever he wills, especially if there is a good reason for that. If there is no good reason, then the engagement should not be dissolved.
