A wife refusing her husband’s call to bed because he shaves his beard

Question

Asalam allaikum wa rahmatullah wa baraktuh!
I have one Question: I live in Europe. I and many of my frinds has the Problem, that our husbands shaves off their beard and shows their auwrah (Shot jacket and tight trousers).
Due to the fact, that it is forbidden to show one's auwrah and shave the beard, is it permissible for us to stop sexual intercourse with them, until they change their behavior?
Here is no islamic court and the islamic organisations or in the mosque they will never say anything to the mens in this case.

Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad sallallaahu `alayhi wa sallam ( may Allaah exalt his mention ) is His slave and Messenger.

Shaving the beard and showing one’s ‘Awrah are evil matters. Therefore, if those husbands are as you described, then they are wrong, so one must advise them and remind them of Allaah. Some scholars and whoever might have an influence on them should advise them. Also, the wife should also advise her husband about these matters in a soft and gentle manner and she should supplicate Allaah to guide him and turn him into a righteous person.

On the other hand, a wife is not permitted to refuse if her husband calls her to bed unless she has a sound reason. Abu Hurayrah may Allaah be pleased with him narrated that the Prophet sallallaahu `alayhi wa sallam ( may Allaah exalt his mention ) said: ''When a man calls his wife to his bed (for intercourse) and she refuses, the angels will curse her till the morning." [Al-Bukhari and Muslim]

The fact that the husband commits those sins is not a sound reason for the wife to refuse his call to bed. Moreover, if a wife refuses, then this could be a reason for the husband to leave her and establish illicit relationships with other women and this leads to a greater evil and disadvantage as we clarified in Fatwa 88547.

Allaah Knows best.
