Marrying a disbelieving woman on condition that she embraces Islam after marriage

Question

What is the ruling on marrying a Hindu woman on the condition that she embraces Islam after marriage?

Answer

All perfect praise be to Allaah, the Lord of the worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad, sallallaahu ‘alayhi wa sallam, is His Slave and Messenger.

Scholars unanimously agree that marrying a Hindu woman before she has embraced Islam is invalid, even if the husband stipulates the condition that she should embrace Islam after the conclusion of the marriage contract. Allaah The Almighty Says (what means): {And do not marry polytheistic women until they believe.} [Quran 2:221]

Consequently, being a Muslim is a condition for the validity of marriage, and mere determination is not enough in this respect.
