Her uncle took a commission when helping them buy a piece of land

Question

i am an NRE we took a peice of land through one of our close relative yani ... my mothers real brother who is veri pious & haji ......i often call him 2 find a land for investment purpose ..he along with his friend ,who is a broker shown us a land ....the deal is done it was beyond our budget but some how we managed .....taking loan frm my other freinds & relatives .....NOW I CAME 2 KNOW THAT MY MATERNAL UNCLE & HIS BROKER FREIND TOOK COMMISION & SHARED EQUALLY ....IS IT ALLOWED IN ISLAM ?? PLZ GUIDE ????????? THEN how islam justifies VALUES O RELATIONS .....???

Answer

All perfect praise be to Allaah, the Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad, sallallaahu ‘alayhi wa sallam, is His Slave and Messenger.

If your relative and his friend the broker had taken a commission from you without your knowledge and this is not something that is usual according to the customs, then they were not permitted to do so, as they were obliged to inform you of the price of the land and the amount of the commission which they wanted to take from you in return for looking for a land for you. But if according to the customs, they deserve such a commission for endeavouring to find a land for you, then they may take a commission equal to the commission anyone else would take for this kind of effort; because what is known among people to be part of the customs takes the same ruling as what is mentioned in religious texts.

Indeed, Islam has clarified the principle that governs the financial transactions among people in the Quranic verse (which means): {O you who have believed, do not consume one another’s wealth unjustly but only [in lawful] business by mutual consent.}[Quran 4:29]

Therefore, there is nothing wrong with anything that was concluded by consent (between both parties), but what was due to cheating and deception is not permissible.
