Fatwa No: 86193

Many people ask if you give a false statement and help to grant a status to stay in another country and you get benefit and help as a refugee. Is it right to use the benefit for your living and can you spend for Allah way. Second if you work but not on your name of birth and that using ID Card of another person is that right to do so in Islam.

Praise be to Allah, the Lord of the Worlds; and may His blessings and peace be upon our Prophet Muhammad and upon all his Family and Companions.Giving false statement to get residence permit visa in a non-Muslim country is forbidden, it is even among the major sins. The Prophet (Sallallahu Alaihi wa Sallam) said: "Shall I not inform you of the biggest of the great sins?" We said, "Yes, O Allah's Apostle" He said, "To join partners in worship with Allah; to be undutiful to one's parents". The Prophet sat up after he had been reclining and added, "And I warn you against giving forged statement and a false witness; I warn you against giving a forged statement and a false witness". The Prophet kept on saying that warning till we thought that he would not stop" . [ al-Bukhari and Muslim ]As for the benefits that a person gets by giving a forged statement they are also forbidden regardless of the place. Know that the property of a Kafir who is not in the state of war with Muslims is respected. Also, if a Muslim enters a non-Muslim country, he enters with an agreement and a promise, so he is not allowed to take their money by cheating, lying or any other unlawful means. So, spending the amounts that are taken by unlawful means in the way of Allah is also forbidden since Allah is Good and does not accept except that which is good. Therefore, one should give such amounts back to them if it is possible; otherwise, he should give such amounts in public interest to get rid of them. It is also forbidden to use other's name or identity card to work because it is a kind of cheating which is forbidden in Shariah. The Prophet (Sallallahu Alaihi wa Sallam) said: Whoever cheats others is not one of us . [Saheeh Muslim ]. Allah knows best.
