Lost his mental balance, humiliated the Quran and divorced his wife

Question

i am 30 year old sunni muslim form india. i am married & i have a four children. when i am 15 years old my elder brother is dead. after his death i lose my mental balance & fear & afraid about death & lose my mental balance about 80% not 100% when i married my wife is not live with me before the 4 year of marriage than i see sex dream & continous night fall about 4 years when my wife coming after 4 year of our marriage i am not sucees to do intercourse with my wife bcoz my mind is not in my control after try & try i am not suceed to do intercourse with my wife then i anger with allah & leave the holy quran under my foot then i say to my wife talaaq talaaq talaaq & u go to my life my wife go his father home & come back after some time i dont remember how much time he live his fathershe says to me that it's not the way you give me talaaq our nikaah still valid after 10 month i took a drug (marizuana) then i suceed to do intercorse with my wife then my first daughter born after second daughter then my son born onw night i drink my wife milk i donot know i drink 2 time 3 time or 4 time then i think it's not right after this incident my 2nd son born now i think i am bad & it's better to i will sucide is my wife, childs is haram or i am haram suggest me what can i do now

Answer

All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad, sallallaahu ‘alayhi wa sallam, is His slave and Messenger.

First of all, you should take it easy, because otherwise this could lead to unpleasant consequences. You are not permitted to commit suicide because it is one of the grave major sins. Furthermore, suicide does not solve the problem; rather this may increase your hardship. For more benefit on the outcome of suicide, please refer to Fatwa 84296. We advise you to be patient, as the outcome of patience is good.

As regards your statement that you were angry against Allaah, and putting the Mus-haf (i.e. the Arabic text of the Quran) under your feet, then this is a very serious matter. If you were conscious when you did so, then this is disbelief in Allaah and an act of apostasy. In this case, your wife becomes forbidden for you unless you had repented to Allaah and re-embraced Islam before her waiting period expired. However, if you did so while being unconscious of your actions, then there is no sin on you.

The same thing applies to uttering the word divorce, if this happened when you were unconscious about what you were saying, then this does not lead to divorce, but if you were conscious about what you were saying, then saying to your wife "divorce, divorce, divorce" is a clear statement of divorce according to many scholars  may  Allaah  have  mercy  upon  them so this leads to divorce even if you had not intended it. Also, according to the majority of the scholars  may  Allaah  have  mercy  upon  them this is considered as three divorces if you had not intended to confirm the first divorce with the second and third divorces which you uttered. In case you only intended to confirm the first divorce with the second and third divorces, then it is only considered as one divorce.

If we presume that three divorces had taken place, then your wife becomes forbidden for you, unless she sincerely marries another man [who consummates the marriage with her and then divorces her or dies]; for more benefit, please refer to Fatwa 84170.

As regards your children, they are traced back to you since you had intercourse with your wife while believing that she is your wife; for more benefit, please refer to Fatwa 84811.

With regard to breastfeeding, then breastfeeding an adult does not make the relation with him forbidden; this is the view of the majority of the scholars  may  Allaah  have  mercy  upon  them; for more benefit, please refer to Fatwa 90612.

Concerning marijuana, it is not permissible to consume it because the ruling of intoxicants applies to it as we clarified in Fataawa 86558 and 85583. You may consult the specialist physicians in order to prescribe for you an appropriate medicine instead of marijuana.
